Hi Susan,
Some people are just selfish and shallow and unfortunately your brother fell into the claws of one of them.
Your brother needs the emotional support of your family, and also the best divorce attorney he can afford. He needs to start legal action,now, including asking to be the custodial parent. He has to show from the start of the divorce why he is the better parent. You and your parents have to be able to back him up.
Your brother needs to show that he has been the primary care giver, and ask to be the custodial parent right away.
I'm not an attorney, I just know someone in a similar situation and what he did to gain custody of his son.
What you can do to help your nephew, no matter who has custody until the divorce is settled, is spend time with him: playing, reading stories, taking him to places kids like. Let him know he's not being abandoned and that daddy and his family love him.
