As most of you here in the U.S. are to well aware, most long-term disability policies discriminate against mental health disabilities by limiting coverage to 24 months. The 11 Circuit Court of Appeals appears to have ruled that this violates the Americans with Disabilities Act. While this decision, if upheld by the Supreme Court, only will cover Florida, Georgia, and Alabama, it could set important precedent for other circuits to follow. Combined with tougher parity legislation (that is still foundering in the House of Representatives -- have you called or wrote your representative yet?), progress could be made in ending some of the discrimination that occurs in the treatment of the mental ill and disabled.
