As long as Dr. Bob is collecting the full fee, and paying a portion over to someone else, that might be viewed as fee splitting particularly if what he is retaining is calculated on a percentage and not a fixed fee basis. Here, he is making referrals presumably to other docs, but if any of them are foreign doctors and not licensed in the US, they might not be acknowledged as fellow professionals. This is just how I might analyze this and is very seat-of-the-pants. As I said before, I make no claim to knowing what I'm talking about. K
