Too far? Or just right?

OK, this isn't a med question, but its related to shrinks, so here goes....

Back in the day, I had a d-bag shrink as an inpatient. He diagnosed narcissism and a low IQ, gave me high dose Cymbalta, treated me like crap. Whatever, it happens.

Then, he broke confidentiality. He even made fun of me because of my then-receded hair line (its better now) and my homosexuality. Last year, when I randomly saw him on the street, he flexed his muscles and tried to stare me down. I'm not into that macho BS, but I figured I'd just stare back, and then he ended up looking away (and he made a big damn deal out of it, too).

OK, so I later called the Office of Civil Rights and filed a HIPPA complaint against him. Haven't heard from them. He also had to answer a subpoena from the medical board when I filed a complaint against a different shrink.

So, today, I called both places he works--the mental hospital and the private practice. For the mental hospital, I asked to be transferred to whomever handles HIPPA complaints. I told her about one incident, told her I was considering legal action and that I needed to know that it wouldn't happen again. I also told her that I'd been talking to the Citizens Commission on Human Rights (www.cchr.org).

The private practice was a little different. The only way to leave a message was to call the "new patients" line and leave my info. I said I'd been treated by Dr.X back in the day, and he'd gone around making fun of me and breaking confidentiality. I said that "if Dr.X pulls that homophobic bullsh!t on me again, there will be Hell to pay." I left my name and phone number.

So, what say all of you?

There's not much you can do, expect actually filing a lawsuit case for breaking confidenciality and that will be very tough. I have had many doctors treat me like I was simply not much to respect at all. It won't make much diffrence if you call and complain on his line because they will simply ignore it, it depends on how you say it that will catch there attention. I've called my doctor and she ignores alot of my comments of my condition until I actually see her in the session. Recall him and leave a long detailed message that you would like to see him about your condition, exlain it and use metaphores in detail.

His office called back. The doc in question is apparently out-of-town, but some nice sounding lady called me. She tried to sound soothing and sweet. She told me she doubted Dr.-- would do such a thing; I tried to politely stand my ground.

Anyway, at one point during the (thankfully) brief convo, she asked if I'd like her to discuss this w/ the doc and/or his supervisor (I didn't know shrinks *had* supervisors; weird). I said yes, please.

We'll see what happens. I fired off an email to the Citizen's Commission on Human Rights. We'll see what they have to say.

CE seriously you can google the medical board in your state and online write a complaint. I did this when old pdoc was leaving and not referring patients to other doctors. I said I wanted to remain ananymous. I received two replies back in am as wrote at night. Said I had to give name. Since I couldn't remain ananymous I withdrew the complaint via email. But interestingly next time saw her they had sent out a letter with referring docs names. So it can be done. Phillipa

Well, if you have a grudge to settle and you think you've got legitimate evidence to back it up, there are attorneys who will do the work for you and take a chunk (usually around 30%-50%) of the money you are awarded as their pay so you don't have to pay them up front. If you lose, you owe nothing. Sometimes it's better just to drop it, forgive it, and move on. I'm just saying, if you want to go forward, do it right. There are always going to be idiots throughout our lives and he certainly will not be the only one in yours. But if you want to hold him accountable, do it in a way that will make a difference. That means a commissioned attorney.
